1. Agreement to Terms
By accessing or using RelayIt ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to both:
- RelayIt Cloud: Our hosted notification relay service
- RelayIt Self-Hosted: Our open-source software for self-deployment
2. Description of Service
RelayIt is a notification relay service that enables developers to send messages across multiple channels (email, SMS, WhatsApp, Discord) through a unified API. We act as an intermediary, routing your messages to third-party notification providers using credentials you provide.
3. Account Registration and Security
3.1 Account Creation
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
3.2 Eligibility
- You must be legally capable of entering into binding contracts
- Organizations must have the authority to bind the entity to these Terms
3.3 API Keys and Security
- You are responsible for securing your API keys and access credentials
- You must immediately revoke and regenerate compromised credentials
- We are not liable for unauthorized access resulting from compromised credentials
4. Service Plans and Payment
4.1 Service Tiers
We offer various service tiers as described on our pricing page, including free and paid options.
4.2 Payment Terms
- Subscription fees are billed in advance and are non-refundable except as specified
- Usage-based charges are billed monthly in arrears
- All payments are processed through Stripe
- Prices may change with 30 days notice
4.3 Refund Policy
- No refunds are provided if you have sent more than 50 messages in the billing period
- Pro-rated refunds may be available for annual subscriptions in certain circumstances
- Refund requests must be submitted within 30 days of the billing date
4.4 Account Suspension
We may suspend or terminate accounts for non-payment after reasonable notice.
5. Acceptable Use
5.1 Permitted Use
You may use RelayIt to send legitimate notifications and messages through supported channels.
5.2 Prohibited Activities
You may not use RelayIt to:
- Send spam, unsolicited messages, or bulk marketing communications
- Distribute malware, viruses, or malicious content
- Send illegal, harmful, or offensive content
- Engage in harassment, phishing, or fraudulent activities
- Send adult content or inappropriate material
- Violate any applicable laws or regulations
- Circumvent service limitations or restrictions
- Resell or redistribute the service (for self-hosted versions)
5.3 Content Monitoring
We may monitor message content and metadata to ensure compliance with these Terms and applicable laws.
6. Service Availability and Performance
6.1 Service Level
- We provide RelayIt Cloud on a "best effort" basis
- We target 99.5% uptime for paid plans (no SLA for free tier)
- Scheduled maintenance will be announced in advance when possible
6.2 Service Modifications
- We may modify, suspend, or discontinue features with 30 days notice
- We will provide migration tools or assistance where reasonably possible
6.3 Third-Party Dependencies
- We are not responsible for failures of third-party notification providers
- Service availability depends on external APIs and infrastructure
7. Data and Privacy
7.1 Your Data
- You retain ownership of all content and data you submit
- You grant us a limited license to process your data to provide the Service
- We will handle your data according to our Privacy Policy
7.2 Data Retention
- Message content is retained for a maximum of 24 hours (configurable)
- Account data is retained for the duration of your subscription
- You can export your data before account termination
7.3 Data Security
We implement reasonable security measures but cannot guarantee absolute security.
8. Intellectual Property
8.1 RelayIt IP
We retain ownership of the RelayIt service, software, and related intellectual property.
8.2 Open Source License
The self-hosted version is available under the AGPL v3 license at https://github.com/tedtoo/relayit
8.3 User Content
You retain ownership of your content and grant us only the rights necessary to provide the Service.
9. Limitation of Liability
9.1 Service Basis
RelayIt is provided "AS IS" without warranties of any kind. We make no guarantees about message delivery, timing, or reliability.
9.2 Liability Limits
To the maximum extent permitted by law:
- Our total liability is limited to the amount you paid in the 12 months preceding the claim
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for third-party provider failures or limitations
9.3 Message Delivery
- We provide "best effort" message delivery but do not guarantee delivery
- Delivery depends on third-party providers and is outside our control
- We are not liable for failed, delayed, or misdirected messages
10. Indemnification
You agree to indemnify and hold us harmless from claims arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of applicable laws
- Content you submit through the Service
11. Termination
11.1 Termination by You
You may terminate your account at any time by deleting it through our interface.
11.2 Termination by Us
We may terminate accounts:
- For violation of these Terms (with 24 hours notice)
- For extended non-payment (with reasonable notice)
- If required by law or to protect our rights
11.3 Effect of Termination
Upon termination:
- Your access to the Service will cease
- We will provide data export for 30 days
- Unpaid fees become immediately due
12. Dispute Resolution
12.1 Informal Resolution
Before initiating formal proceedings, parties agree to attempt informal resolution for 30 days.
12.2 Governing Law
These Terms are governed by Australian law. Any disputes will be resolved in the courts of New South Wales, Australia.
12.3 Limitation Period
Any claims must be brought within one year of the cause of action arising.
13. General Provisions
13.1 Modifications
We may modify these Terms with 30 days notice. Continued use constitutes acceptance of changes.
13.2 Severability
If any provision is found invalid, the remainder of these Terms remains in effect.
13.3 Assignment
We may assign these Terms without consent. You may not assign your rights without our written consent.
13.4 Entire Agreement
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement.
